Looks like it is getting ready to bloom, so you will be able to tell soon. It reminded me at first of my monkshood that is getting ready to bloom also. The leaves on my plants are too hidden or tattered, but I don't think they quite match. Will be waiting to find out. I' m always looking for fall bloomers.
Tina, this one has blooms of orange, yellow or red, and the leaves are different from Cosmos bipinnatus. A very pretty plant that I used to grow each year.
Cosmos bipinnatus (Garden Cosmos, Mexican Aster) Cosmos sulphureus (Sulphur Cosmos, Yellow Cosmos) Same Genus but different species. Yours will readily self seed and return year after year and even though the information says they will only reach a height of about 1.5 feet...I had some last year that were over 5 feet tall and their progeny is almost that tall this year.
Thanks for the information, Toni. Mine appeared out of no where under a tree and still hasn't bloomed. Its close to blooming though. I will be happy if it reseeds.

They both have beautiful flowers. I'm glad you asked what it is. I probably would have pulled it before it bloomed thinking it was a weed!
